{"id":4054,"date":"2021-03-06T00:00:00","date_gmt":"2021-03-06T00:00:00","guid":{"rendered":"https:\/\/well-tax.com\/brexit-new-developments-for-posted-workers\/"},"modified":"2023-09-25T18:56:46","modified_gmt":"2023-09-25T17:56:46","slug":"brexit-nuovi-sviluppi-per-i-lavoratori-distaccati","status":"publish","type":"post","link":"https:\/\/well-tax.com\/it\/brexit-new-developments-for-posted-workers\/","title":{"rendered":"Brexit: nuovi sviluppi per i lavoratori distaccati"},"content":{"rendered":"<p>L'Unione Europea e la Comunit\u00e0 Europea dell'Energia Atomica devono trovare un accordo, TCA (Trade and Cooperation Agreement), con la Gran Bretagna e l'Irlanda del Nord per regolare la cooperazione tra i Paesi aderenti in settori come quello delle assicurazioni sociali.<\/p>\n<p>Sebbene l'accordo sia ancora in fase di revisione, i Paesi aderenti possono applicare provvisoriamente le sue direttive a partire dal 1\u00b0 gennaio 2011.<sup>st<\/sup> Gennaio 2021. Per quanto riguarda il settore delle assicurazioni sociali, le direttive che integreranno l'accordo TCA saranno valide per 15 anni a partire dalla loro entrata in vigore. Inoltre, le direttive stabiliscono che i lavoratori distaccati continueranno a essere soggetti alla legislazione e alla fiscalit\u00e0 dello Stato in cui svolgono abitualmente il loro lavoro, a condizione che:<\/p>\n<p>1 - la loro attivit\u00e0 lavorativa non sia svolta in uno Stato aderente al TCA per un periodo superiore a 24 mesi e che il datore di lavoro non lo invii in uno Stato aderente per sostituire un altro lavoratore distaccato;<br \/>\n2 - un lavoratore autonomo che svolge abitualmente il proprio lavoro in uno Stato e che ha la necessit\u00e0 di svolgere il proprio lavoro in un altro Stato aderente sar\u00e0 soggetto alla legislazione del primo Stato, a condizione che il periodo della sua attivit\u00e0 non superi i 24 mesi.\u00a0<\/p>\n<p>Queste norme si applicano a Paesi come l'Italia, a causa della loro intenzione di aderire all'accordo.<br \/>\nA questo proposito, l'INPS afferma che la durata del distacco continuativo non pu\u00f2 superare i 24 mesi, compreso l'eventuale periodo antecedente al 1<sup>st<\/sup> gennaio 2021, a meno che non si decida diversamente firmando un accordo di deroga all'articolo 16 del Regolamento CE n. 883\/2004.<\/p>\n<p>Per rimanere sempre aggiornati sulla Brexit, contattateci a <a href=\"mailto:info@well-tax.com\">info@well-tax.com<\/a> o seguiteci sui nostri social media.<\/p>\n<p>\u00a0<\/p>\n<p>Autore<\/p>\n<p>Marco Mittica<\/p>","protected":false},"excerpt":{"rendered":"<p>The European Union and the European Atomic Energy Community are due to find an agreement, TCA (Trade and Cooperation Agreement), with Great Britain and Northern Ireland to regulate the cooperation among those adhering countries in sectors such as the social insurance.
