{"id":3918,"date":"2017-06-29T00:00:00","date_gmt":"2017-06-28T23:00:00","guid":{"rendered":"https:\/\/well-tax.com\/pension-scheme-at-a-glance\/"},"modified":"2024-03-08T09:27:19","modified_gmt":"2024-03-08T09:27:19","slug":"resumen-del-regimen-de-pensiones","status":"publish","type":"post","link":"https:\/\/well-tax.com\/es\/pension-scheme-at-a-glance\/","title":{"rendered":"El sistema de pensiones brit\u00e1nico"},"content":{"rendered":"<p>El <a href=\"https:\/\/well-tax.com\/es\/pagina-especifica\/18\/pension-schemes\/\">sistema de pensiones brit\u00e1nico<\/a> es muy diferente del italiano. Las \u00faltimas reformas, de reciente introducci\u00f3n, tienen como objetivo hacer que el proceso sea m\u00e1s f\u00e1cil de comprender.<\/p>\n<p>El sistema de pensiones brit\u00e1nico se divide en dos secciones principales: <em>Pensi\u00f3n estatal<\/em> y <em>los sistemas de Pensi\u00f3n Privados.<\/em>.<\/p>\n<p><u>Pensi\u00f3n estatal<\/u>:<\/p>\n<p>Para percibir una pensi\u00f3n estatal de un importe m\u00ednimo, deber\u00e1 haberse alcanzado la edad de jubilaci\u00f3n con al menos 10 a\u00f1os de cotizaci\u00f3n, mientras que para percibir el importe m\u00e1ximo ser\u00e1 necesario haber cotizado un total de 35 a\u00f1os. No obstante, el sistema de pensiones estatales en todo caso resulta insuficiente, ya que se sit\u00faa por debajo del umbral de la pobreza.<\/p>\n<p><u>Pensi\u00f3n privada<\/u>:<\/p>\n<ul>\n<li><em>Pensi\u00f3n individual<\/em>:<\/li>\n<\/ul>\n<p>En esta categor\u00eda se incluyen los planes de pensiones personales, stakeholder pensions (o sistemas de pensi\u00f3n por participaci\u00f3n) y los self-invested personal pensions (SIPPs)(o planes de pensiones de inversi\u00f3n personal). El importe de cada pensi\u00f3n depender\u00e1 en lo que hayamos ido aportando y el grado de riesgo del fondo de inversi\u00f3n correspondiente. Adem\u00e1s, nuestros socios o empresas tambi\u00e9n podr\u00e1n contribuir a nuestro propio plan de pensiones (con planes de pensiones de empresa). Existen muchas opciones a la hora de elegir a nuestro proveedor de planes de pensiones individuales.<\/p>\n<p>Los sistemas de Stakeholder pensions son una forma de pensi\u00f3n de contribuci\u00f3n definida. Ofrecen contribuciones m\u00ednimas y flexibles, cobertura de tasas y estrategias de inversi\u00f3n predefinidas. Algunas empresas los ofrecen, pero tambi\u00e9n los pueden contratar personas f\u00edsicas por su propia cuenta.<\/p>\n<p>Los sistemas de self-invested personal pension (SIPP) son como los planes de pensiones personales est\u00e1ndar. La principal diferencia es que ofrecen mayor flexibilidad al no contar con inversiones predefinidas.<\/p>\n<ul>\n<li><em>Planes de pensiones de empresa<\/em>:<\/li>\n<\/ul>\n<p>A partir de 2018, todas las empresas ofrecer\u00e1n a sus empleados un \u201csistema de plan de pensi\u00f3n de empresa\u201d.<\/p>\n<p>La nueva normativa ofrecer\u00e1 a todos los trabajadores la posibilidad de ahorrar para su jubilaci\u00f3n.<\/p>\n<p>Este procedimiento se denomina automatic enrolment o \u201cinclusi\u00f3n autom\u00e1tica\u201d.<\/p>\n<p>La contribuci\u00f3n m\u00ednima consistir\u00e1 en determinados fondos del salario del trabajador, la empresa y la deuda fiscal estatal.<\/p>\n<p>Las empresas deber\u00e1n inscribir autom\u00e1ticamente a sus empleados en un sistema de pensiones y contribuir para su jubilaci\u00f3n con las siguientes condiciones para optar a los mismos:<\/p>\n<ul>\n<li>tener la clasificaci\u00f3n de \u201cempleado\u201d;<\/li>\n<li>tener entre 22 a\u00f1os y la edad de jubilaci\u00f3n;<\/li>\n<li>percibir al menos 10.000 libras al a\u00f1o;<\/li>\n<li>trabajar habitualmente en Reino Unido.<\/li>\n<\/ul>\n<p>Los trabajadores que no cumplan estos requisitos y por consiguiente no queden inscritos autom\u00e1ticamente, tambi\u00e9n tendr\u00e1n derecho a solicitar su inclusi\u00f3n en el mismo sistema, si as\u00ed lo desean.<\/p>\n<p>En ciertos casos, los administradores de sociedades podr\u00e1n quedar exentos de su obligaci\u00f3n de \u201cinclusi\u00f3n autom\u00e1tica\u201d aunque cuenten con un contrato de trabajo. La raz\u00f3n es que, en estos casos, los administradores de sociedad no tienen la clasificaci\u00f3n de empleados.<\/p>\n<p>Los administradores de sociedad tendr\u00e1n la consideraci\u00f3n de empleados siempre que:<\/p>\n<ul>\n<li>tengan firmado un contrato con la organizaci\u00f3n;<\/li>\n<li>al menos otra persona (que podr\u00e1 ser otro administrador) tenga firmado tambi\u00e9n un contrato con la organizaci\u00f3n.<\/li>\n<\/ul>\n<p>No ser\u00e1 necesario que el contrato de trabajo se celebre por escrito; tambi\u00e9n ser\u00e1n v\u00e1lidos los contratos orales o impl\u00edcitos.<\/p>\n<p>En caso de que un administrador no cuente con un contrato de trabajo, no podr\u00e1 considerarse empleado y quedar\u00e1 por tanto exento de la inclusi\u00f3n autom\u00e1tica.<\/p>\n<p>Solamente estar\u00e1n sujetas a esta obligaci\u00f3n de registro autom\u00e1tico las organizaciones que cuenten con empleados.<\/p>\n<p>Existen dos tipos de pensiones de empresa:<\/p>\n<p>- <em>contribuci\u00f3n definida<\/em>: el importe retenido por el empleado y por la empresa se invierte. Desde los 55 a\u00f1os, podremos rescatarlo en efectivo, mantener un sistema de ingresos u optar por una f\u00f3rmula mixta.<\/p>\n<p>- <em>beneficios definidos<\/em>: el importe recibido depender\u00e1 del salario en el momento de la jubilaci\u00f3n y del tiempo que se haya trabajado en la empresa.<\/p>\n<p>La contribuci\u00f3n m\u00ednima ir\u00e1 aumentando de forma gradual desde el 2% (a partir de octubre de 2012) hasta el 8%. Las fechas en que se espera que se produzcan incrementos hasta el 5% y el 8% son abril de 2018 y abril 2019.<\/p>\n<table border=\"1\" cellspacing=\"0\" cellpadding=\"0\">\n<tbody>\n<tr>\n<td style=\"width: 214px;\"><\/td>\n<td style=\"width: 214px;\">Empresario<\/td>\n<td style=\"width: 214px;\">Empleado<\/td>\n<\/tr>\n<tr>\n<td style=\"width: 214px;\">Abril de 2017<\/td>\n<td style=\"width: 214px;\">1%<\/td>\n<td style=\"width: 214px;\">1%<\/td>\n<\/tr>\n<tr>\n<td style=\"width: 214px;\">Abril de 2018<\/td>\n<td style=\"width: 214px;\">2%<\/td>\n<td style=\"width: 214px;\">3%<\/td>\n<\/tr>\n<tr>\n<td style=\"width: 214px;\">Abril de 2019<\/td>\n<td style=\"width: 214px;\">3%<\/td>\n<td style=\"width: 214px;\">5%<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p>Las empresas deber\u00e1n inscribir a sus empleados 30 d\u00edas antes de la fecha de entrada en vigor prevista por el gobierno y cumplimentar la declaraci\u00f3n de cumplimiento en la p\u00e1gina web del \u00f3rgano regulador de las pensiones.<\/p>\n<p>Podremos decidir dar de baja nuestro plan de pensiones en cualquier momento. Si hemos sido objeto de la inclusi\u00f3n autom\u00e1tica, podremos dar de baja el mismo en un plazo de un mes desde que la empresa nos haya incluido en el \u201csistema de pensiones de la empresa\u201d a trav\u00e9s de un procedimiento denominado opting-out (u opci\u00f3n de exclusi\u00f3n); en tal caso, nos reembolsar\u00e1n los importes aportados. Si optamos por dar de baja el sistema una vez finalizado dicho plazo de un mes (baja en el sistema), es posible que no logremos recuperar los pagos realizados (depender\u00e1 del tipo de plan de pensiones).
